1 Draft the business plan and operating assumptions recommended · Start with the Texas.gov checklist, City of Austin startup guide, and library research tools. Capture customer, pricing, startup costs, funding need, entity choice, location, and permit assumptions.
2 Choose the business structure required · Review common structure options and use the Texas Secretary of State for LLC, partnership, or corporation filings. Treat legal structure as an advisor-reviewed decision.
3 Check name availability and DBA needs required · Check Texas entity name availability, then route Travis County unincorporated assumed names through the Travis County Clerk when applicable.
4 Form the Texas entity if needed required · Use SOSDirect or other official Texas Secretary of State filing paths for formation documents and current filing fees.
5 Get an EIN directly from the IRS required · Apply through the IRS EIN application. The IRS advises forming a state legal entity before applying when creating an LLC or corporation.
